商標(biāo)侵權(quán)訴訟的訴訟時效
侵犯注冊商標(biāo)專用權(quán)的訴訟時效為二年，自商標(biāo)注冊人或者利害權(quán)利人知道或者應(yīng)當(dāng)知道侵權(quán)行為之日起計算。商標(biāo)注冊人或者利害關(guān)系人超過二年起訴的，如果侵權(quán)行為在起訴時仍在持續(xù)，在該注冊商標(biāo)專用權(quán)有效期限內(nèi)，人民法院應(yīng)當(dāng)判決被告停止侵權(quán)行為，侵權(quán)損害賠償數(shù)額應(yīng)當(dāng)自權(quán)利人向人民法院起訴之日起向前推算二年計算。
